Settling cases is an art and a science. Over the years, I’ve learned a lot about both aspects of negotiation and settlement. I even (partially) interrupted my legal career in the early aughts to get a masters degree in counseling, largely to satiate my curiosity about what motivates humans and makes us tick. Studying and following on a micro level how people are processing complex issues and emotions in a room is, strange as it may sound, my happy place.
But what I always wanted to know about a mediator when I represented a client was simply this: can you get the parties to negotiate in good faith and to reach a settlement everyone—especially my client, but also including me—can live with?
My experience as a litigator of hundreds of cases, as a mediator of hundreds of cases, and as a student of psychology and negotiation uniquely qualifies me to sit in the trenches with you and your client—and that crazy-making opposing party and their lawyer—and get everyone together on a page they can agree upon. I know how to build trust, how to push, when to back off, and how to apply just the right mix, moment to moment. I respect that you, the lawyer, have been in the foxhole with your client from the beginning: which means I make the time really get your take on things. And I realize this all needs to be done with efficiency, care and with an eye on the bottom line.
